By accessing EMB Flex or placing an order for embroidery digitizing or vector art services, you agree to comply with these Terms. If you disagree with any part of these terms, please discontinue using our website and services.

2. Intellectual Property Rights

All logos, designs, files, and content created or delivered by EMB Flex remain our intellectual property until full payment has been received. After payment, ownership of the final digitized or vectorized file is transferred to the client.

• Our site content and design templates are protected by copyright laws.
• You may not resell or redistribute our artwork without written consent.
• Customer-uploaded logos remain the property of the customer.
• All sample designs displayed on our site are for portfolio and promotional use only.

3. User Accounts

To place orders or track progress, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

EMB Flex provides embroidery digitizing and vector conversion “as is.” While we ensure accuracy and quality, minor variations may occur due to machine settings, thread types, or software differences.

EMB Flex shall not be held liable for any loss, damage, or expense resulting from errors in user-provided artwork, incorrect machine setup, or misuse of delivered files.

Our liability shall not exceed the total amount paid for the specific order.

7. Payment and Refund Policy

All payments must be completed before final file delivery. Refunds may be provided only in cases where:

• The wrong file format was delivered
• A duplicate payment was made in error
• The delivered file cannot be used due to an internal technical fault

No refunds will be issued for design quality disputes caused by incorrect user input or embroidery setup.

You agree to indemnify and hold EMB Flex harmless from any claims or damages arising from your use of our services or violation of these Terms.

We reserve the right to suspend or terminate your account or order without notice if you violate our policies, submit fraudulent designs, or misuse the platform.

These Terms shall be governed by and interpreted according to the laws of the United States and the State of New York, without regard to conflict of law principles.
